By selecting "Accept" or by participating in a league run by UTFL LLC, the undersigned, all of his/her personal representative, executors, executrixes, heirs, next of kin, spouse, and assigns (collectively, the “Player”) do hereby agree as follows:
1. The Player ACKNOWLEDGES that there is INHERENT DANGER in the participation in any and all football activities, which the undersigned appreciates and voluntarily assumes. The Player understands that this is release of all claims. The Player understands that he/she assumes all risks inherent in all participation.
2. The Player FULLY RELEASES, FULLY WAIVES, FULLY DISCHARGES, AND COVENANTS NOT TO SUE UTFL LLC, its operators or Owner, officers, directors, shareholders, employees, agents, managers, attorneys, subsidiaries, independent contractors, successor or assigns, (collectively, the “UTFL”) and each of them, from any and all claims, and/or the ordinary negligence of the UTFL, and/or the strict liability, and/or the negligence of any third party, which causes the Player injury, death, personal injury, bodily injury, property damages, or any other type or kind of injury, and/or loss, and/or damages. The Player hereby covenants to hold the UTFL harmless from and to fully indemnify the UTFL for any type or kind of damages, judgments, awards, or related expenses (including but not limited to the UTFL’s attorney fees and court costs) incurred by the UTFL as a result of the participation of the Player in any activity, and/or game, and/or match, and/or practices, and/or camps, and/or scrimmages, and/or leagues, conducted by or related to the UTFL.
3. The Player warrants and represents that he/she is at least 18 years of age, and is physically fit and sufficiently trained to play and participate in the UTFL. The Player verifies that he/she shall cover any and all medical, expenses that may arise from the Player’s participation in the UTFL leagues, or other activities.
4. Terms and Conditions:
* If any part of this agreement is held to be illegal or invalid, that part shall be considered severed and deleted. Such severance and deletion shall not change the validity of the remaining provisions of this agreement, which shall remain in full force and effect.
* This Agreement shall be in full force and effect at all times during Player’s participation in the football activities, of any kind or nature, and shall remain in force for the duration of any applicable statute of limitations.
* Should any dispute arise pertaining to the terms of this agreement, or should any action be filed or commenced to enforce the terms of this agreement, the prevailing party shall be entitled to recover its reasonable attorney fees and costs, whether or not such dispute proceeds to judgment.
* Player agrees that any dispute between the Player and the UTFL shall be resolved in the courts located in Salt Lake County, Utah, and hereby agrees to submit to the jurisdiction of those courts.
* The UTFL may change this Agreement from time to time, if you continue to participate with the UTFL, or its football activities, you agree to those modifications.
